Terms of Service

§1. General provisions

These Terms of Service set out the rules for using the Kinect application — an online tool for logging workouts, tracking physical-activity progress, and participating in training communities. The application is operated by Kuba Borkowski, conducting unregistered business activity (Polish: działalność nierejestrowana), Plac Wilsona 4/24, 01-626 Warsaw, Poland (the "Provider"). Creating an account and using the application constitutes acceptance of these Terms. The application is intended for persons aged 16 and over. These Terms constitute terms of service for the provision of services by electronic means within the meaning of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.

§2. Scope of services

Kinect provides tools to:

Kinect is free to use. All features — including AI training tools, AI next-session suggestions, full workout history, and the Biometric Archive — are available to every account at no charge.

The Provider may change, add, or withdraw features, and may introduce paid plans in the future. Material changes will be communicated in advance.

§3. User account

Using the application requires creating an account. Registration is carried out using an email address and password (minimum 6 characters) or a Google account. During the testing (beta) period, registration may require an access code.

The user undertakes to provide accurate information, keep the password confidential, and not share the account with third parties. One person may hold one account.

§4. Right of withdrawal

Consumers in the EU have a statutory right to withdraw from the contract within 14 days of its conclusion without giving a reason, in accordance with the Polish Act of 30 May 2014 on Consumer Rights.

§5. Complaints

Complaints regarding the operation of the application and the conformity of the digital service with the contract may be submitted to contact@getkinect.app. The Provider reviews complaints within 14 days of receipt and informs the user of the outcome.

§6. Community features (Tribe)

The application allows users to create and join training communities and to publish content (including community names and descriptions, achievements, reactions). The user publishes content at their own responsibility and undertakes not to post content that is unlawful, offensive, misleading, infringes third-party rights, or is unrelated to the application's subject matter.

The Provider may remove content that breaches these Terms and may restrict or block access to community features for users who violate the rules of their use.

§7. Rules of use

It is prohibited to use the application in a manner that breaches the law or these Terms, in particular: attempting unauthorized access to the application or other users' data, disrupting its operation, automated data collection (scraping), and using the application for commercial purposes without the Provider's consent.

§8. Artificial-intelligence features

The application offers features generated automatically by artificial-intelligence algorithms (including training plans, next-session suggestions, weekly recaps). Such content is informational and supportive only, may be inaccurate or incomplete, and does not constitute coaching or medical advice.

§9. Informational nature and absence of medical advice

Kinect is a tool that supports independent tracking of physical activity. The application does not provide medical or coaching services and does not replace consultation with a doctor, physiotherapist, or trainer. Before starting or changing a training program — especially in the case of health problems — the user should consult a doctor. The user exercises and uses the application at their own risk.

§10. Intellectual property

The Kinect application, its name, logo, interface, exercise library, and other elements are legally protected and may not be used without the Provider's consent. The user retains rights to content they post themselves in the application and grants the Provider a free, non-exclusive licence to use it to the extent necessary to provide the service (including displaying content to other community members).

§11. Liability

The Provider makes every effort to ensure the application works correctly and without disruption, but does not guarantee uninterrupted availability and reserves the right to technical breaks, including those related to maintenance or development. The Provider is not liable for the consequences of training decisions made by the user based on data or suggestions presented in the application. The provisions of this section do not limit the Provider's liability to the extent that such limitation is not permitted in relation to consumers.

§12. Termination

The user may terminate the contract at any time by deleting their account in the application settings or by contacting the Provider. The Provider may terminate the contract or block an account in the event of a material breach of these Terms — after first calling on the user to cease the breach, unless the breach is gross.

§13. Changes to the Terms

The Provider may amend these Terms for important reasons, such as changes to the application's functionality, changes in the law, or security considerations. Users will be informed of changes in the application or by email at least 14 days in advance. The date of the last update is always shown at the top of the Terms.

§14. Final provisions

In matters not regulated by these Terms, Polish law applies, in particular the Civil Code, the Act on Consumer Rights, and the Act on Providing Services by Electronic Means.

A consumer may use out-of-court means of handling complaints and pursuing claims, including by applying to a permanent consumer arbitration court or to a provincial inspector of the Trade Inspection, or for assistance to a district (municipal) consumer ombudsman. Information on this is available on the website of the Office of Competition and Consumer Protection (uokik.gov.pl).

Disputes involving a consumer are resolved by the court having jurisdiction under general rules. The rules for processing personal data are set out in the Kinect Privacy Policy.
